Harrisonburg Reckless Driving Lawyer: Victor Ortiz is a professional boxer and an actor.  Ortiz was the WBC Welterweight Champion in 2011 and was consistently rated in the top three fighters at his weight for much of his career.  Ortiz acted in The Expendables and in Southpaw.  He also appeared on Dancing With the Stars.  Ortiz grew up in Kansas to Mexican parents.  For a time, Ortiz was raised by his single parent Father who suffered from alcoholism.  Eventually, Ortiz and his five brothers and sisters entered into the care of Kansas child protective services.

Harrisonburg Reckless Driving Lawyer: Before his father left, Ortiz took up boxing and showed great promise.  Ortiz was noticed by Ron Lyle at a Salvation Army Community Center.  Lyle mentored Ortiz into Junior Olympics where he was undefeated.  Lyle was then noticed by Roberto Garcia who began training Ortiz.  At 17 years of age, Ortiz entered the United States Olympic boxing trials but was eliminated in the semifinals.  In 2004, Ortiz entered the professional boxing circuit.  During his career, Ortiz fought many great boxers including Floyd Mayweather.

Harrisonburg Reckless Driving Lawyer:  In 2016 Ortiz was arrested for DUI in Ventura County, California.  He breath test registered 0.21 grams per 210 Liters of breath.  That breath alcohol content qualified Ortiz for the super DUI designation which carries greater penalties than a standard first DUI.  The DUI may not be Ortiz’s worst legal problem since he was on probation for a 2015 assault and battery charge at the Kenny Chesney concert held at the Rose Bowl.  Ortiz should be worried about the “comeback” time from the 2015 charge.

Son of Arkansas Governor Arrested For DWI

Marshall Coach Duhon Charged with DWI

Son of Arkansas Governor Arrested For DWI

Son of Arkansas Governor Arrested For DWI:  William Asa Hutchinson, III is the 40 year old son of Asa Hutchinson, the Governor of Arkansas.  On January 24, 2016, Hutchinson III was involved in a single motor vehicle crash.  According to Arkansas State Police, he reported falling asleep while driving at 4:00 a.m.  At some point,  Hutchinson III’s vehicle slammed into the guardrail at the Interstate 49 southbound exit ramp onto the Fulbright Expressway.  Police reported that Hutchinson III was confused about his direction of travel prior to the motor vehicle accident.  Police did not report how they determined that Hutchinson III’s confusion was due to a concussion received in the high speed crash to the guardrail.  #SonOfArkansasGovernorArrestedForDWI

Son of Arkansas Governor Arrested For DWI:  The state police indicated that a firefighter summonsed to the crash site reported smelling an alcoholic beverage odor in Hutchinson III’s vehicle.  The state police then noticed such odor on Hutchinson’s breath while speaking with him.  The police report indicates that Hutchinson’s eyes were blood shot and watery and he had slurred speech.  The Police did not indicate how they determined that watery eyes were caused by a blood alcohol level over the legal limit.  The police did not explain how they determined that the blood shot eyes were not the product of the late hour, allergies or some other environmental factor.

Son of Arkansas Governor Arrested For DWI:  The police apparently attempted to administer the horizontal gaze nystagmus test to Hutchinson III.  The HGN test is hard to administer properly and there is significant evidence that HGN clues are often present in persons with no Blood Alcohol content and well as persons with low Blood Alcohol Contents.  Hutchinson III was charged with DWI, careless driving and refusal to undergo the evidential breath test.  His court date in the Fayetteville District Court is set for February 22, 2016. #SonOfArkansasGovernorArrestedForDWI

Anyone can pick up a traffic infraction, even noted college athletes.  In August of 2015, J.J. Frazier a University of Georgia Guard on the basketball team was arrested for improper driving and driving suspendedFrazier was jailed at the Athens-Clarke County facility shortly after 3:00 a.m. and was released on a $2,000 bond.  The bond is a financial guarantee by Frazier that he will make all court appearance and be of good behavior prior to his trial.  Georgia Coach Fox released a statement that the charges would be handled internally.  Frazier is the Bulldog’s leading three point shooter who also averaged almost 4 rebounds per game and over 3 assists per game..

Frazier started in 16 games last season, scoring almost 10 points a game.  Frazier especially shined during Georgia’s NCAA tournament game with Mississippi State where he scored 37 points.  In 2014 Frazier was arrested for driving without a license and failure to obey a traffic control device.

Frazier should take the driving suspended charge seriously because many states provide for jail sentences for repeat offenders.  The prosecution will have to prove that Frazier was aware his license was suspended.  For that reason, police officers often question the Accused about whether he or she knew of the suspension.  Instead of engaging in that dialog intended to build a criminal case against you with the possibility of jail simply tell the Officer, “I want a Lawyer.  If I am not under arrest please let me go.”  #BestHarrisonburgRecklessDrivingLawyer

Top Rockingham County Reckless Driving Lawyer: Several years ago Scott Wilson, an American Actor in his 70s was stopped for a possible DUI.  The relevant Officers insisted that Wilson perform the field sobriety tests.  They did so even though the standardized field tests were originally vetted for persons no older than 60 years of age.  Some time thereafter the tests were claimed to be available to drivers as old as 65 even though no new validation studies were attempted.  Even though Wilson was too old for the tests to provide a valid correct arrest decision the officers used them to justify his DUI arrest.  This is one of the problems with the current use of the standardized field sobriety tests — the officers use them as impairment tests rather than as indicators of a blood alcohol level above or below the legal limit.  The investigators who developed the tests were very clear that roadside impairment tests could not be conducted at roadside.  Instead, they developed roadside tests that could project a probability of a blood alcohol content above or below the legal limit.  Officers need to understand a proper use of the roadside tests to make a correct arrest decision.

Top Rockingham County Reckless Driving Lawyer:  Wilson has played in many, many films including, In the Heat of the Night, In Cold Blood, The Great Gatsby, and Dead Man Walking to name a few.  In recent years Wilson is best known for his role in The Walking Dead as Hershel Greene.  Wilson’s character was killed in Season Four.

Best Harrisonburg Reckless Driving Attorney: On May 8, 2015, Jerramy Stevens began his 30 days jail sentence in Manhattan Beach, CaliforniaStevens is a former football player in the National Football League.  Stevens is also married to Hope Solo, a member of the Team USA soccer team.  Stevens was operating a Team USA van when he was arrested for DUI.

Best Harrisonburg Reckless Driving Attorney: The Court also placed Stevens on four years of probation with the condition that he enter and successfully complete two years of alcohol outpatient treatment in Washington State.  Stevens may have earned additional penalties for his conduct during his arrest when he and his wife, Solo, attempted to use their celebrity to gain release.  Stevens would have been much better off asserting his constitutional rights to counsel and against self-incrimination.  Stevens eventually registered a breath test more than twice the 0.08 grams per 210 liters legal limit.

Best Harrisonburg Reckless Driving Attorney:  Most people have absolutely no understanding of their legal rights and how to assert those rights when asserted by police.  Since most people automatically surrender their constitutional rights to counsel and to not incriminate themselves, law enforcement is often confused when someone actually asserts his or her rights.  Stevens gained nothing by cooperating with the police investigation seeking to gain evidence to convict and jail him.  Stevens would have been better off merely telling the Officers: “I want a lawyer.  If I am not under arrest please let me go.”
