Minnesota Lynx Odyssey Sims charged with DUI

In June of 2019, Odyssey Sims, the scoring leader for the Minnesota Lynx professional basketball team received a DUI charge.

Sims was stopped by the Minnesota State Patrol for speeding and an improper lane change on June 6, 2019 near downtown Minneapolis.

Sims blew a 0.20 on the evidential breath tester; the legal limit is 0.08.

Sims apologized to her coaches, her organization and the fans.  She pledged to continue to perform for the team.

Sims scored 15 points in a game approximately 18 hours after she was arrested.

The WNBA did not make any statements at the time of her apology.  Her team did not make any statements then either.

Other WNBA players have been arrested in the past for Driving under the influence.

Diana Taurasi was arrested in 2009.  Kara Braxton was arrested in 2007. Alexis Hornbuckle was arrested in 2010.

UTEP Quarterback’s DWI charge

Kai Locksley is a quarterback for the UTEP Football Team.  Recently he was charged with DWI and three other charges by El Paso police.

Locksley received the following charges; driving while intoxicated (DWI), marijuana possession under 2 ounces, unlawful possession of a weapon and making a terroristic threat.

Locksley was given bond in the amount of almost $3,000.00.  He can have some post that in cash or through a bail bondsman.

Locksley is set to begin is senior season with the UTEP Miners.  Locksley transferred from Iowa Western Community College in the beginning of 2018.  Last year he threw for over 930 years and three touchdowns.

Locksley had transferred to Iowa Western Community College from the University of Texas where he redshirted.  His father is the head coach for the University of Maryland football team.

Reckless Driving:  In late January, 2017, Yordano Ventura, age 25, was killed in a motor vehicle accident while visiting his home in the Dominican Republic.  According to Dominican police, Ventura‘s one car accident occured on the Juan Adrián highway near San Jose de Ocoa. Ventura was alone in the vehicle.  The cause of the collision was not reported.

Reckless Driving: Ventura was known for his lightening like fast ball and his fearlessness against much larger players from other professional baseball teams.  Ventura was an essential element of the pennant victories for his Kansas City Royals and the 2015 World Series.  Two years earlier, Oscar Taveras, another rising young baseball star, was killed in a traffic crash in the DR.  Taveras and his girlfriend were killed near Puerto Plata.  Ventura was pitching in the 2014 World Series and had Taveras‘ initials and number on his baseball cap honoring Taveras.  Coincidentally Andy Marte a retired major league baseball player also died in a vehicle crash in the DR several days earlier than Ventura’s passing.

Reckless Driving: Ventura’s tough attitude often drew unwelcome attention from batters.  On one occasion, Manny Machado charged the pitcher’s mound; on another Mike Trout engaged Ventura in a tense stare down.  Ventura earned over one million dollars in his second season of a five year contract with a twenty-three million dollar guarantee.  Ventura came a long way from a 16 year old signed for $28,000.00 as a project.

Son of Arkansas Governor Arrested For DWI:  William Asa Hutchinson, III is the 40 year old son of Asa Hutchinson, the Governor of Arkansas.  On January 24, 2016, Hutchinson III was involved in a single motor vehicle crash.  According to Arkansas State Police, he reported falling asleep while driving at 4:00 a.m.  At some point,  Hutchinson III’s vehicle slammed into the guardrail at the Interstate 49 southbound exit ramp onto the Fulbright Expressway.  Police reported that Hutchinson III was confused about his direction of travel prior to the motor vehicle accident.  Police did not report how they determined that Hutchinson III’s confusion was due to a concussion received in the high speed crash to the guardrail.  #SonOfArkansasGovernorArrestedForDWI

Son of Arkansas Governor Arrested For DWI:  The state police indicated that a firefighter summonsed to the crash site reported smelling an alcoholic beverage odor in Hutchinson III’s vehicle.  The state police then noticed such odor on Hutchinson’s breath while speaking with him.  The police report indicates that Hutchinson’s eyes were blood shot and watery and he had slurred speech.  The Police did not indicate how they determined that watery eyes were caused by a blood alcohol level over the legal limit.  The police did not explain how they determined that the blood shot eyes were not the product of the late hour, allergies or some other environmental factor.

Son of Arkansas Governor Arrested For DWI:  The police apparently attempted to administer the horizontal gaze nystagmus test to Hutchinson III.  The HGN test is hard to administer properly and there is significant evidence that HGN clues are often present in persons with no Blood Alcohol content and well as persons with low Blood Alcohol Contents.  Hutchinson III was charged with DWI, careless driving and refusal to undergo the evidential breath test.  His court date in the Fayetteville District Court is set for February 22, 2016. #SonOfArkansasGovernorArrestedForDWI

This author is always concerned when a former football player makes the news for aberrant behavior in light of the new information about Chronic Traumatic Encephalopathy (CTE).  CTE is a degenerative disorder found in persons who have suffered multiple brain injuries like concussions.  Because the condition is common in boxers, CTE used to be described as dementia pugilistica.  CTE is prevalent in athletes in contact sports such as football, ice hockey and professional wrestling.  Persons suffering from CTE usually exhibit memory loss, aggression, confusion and depression.  CTE is very similar to dementia in younger people.  Soldiers are also subject to CTE due to explosions causing concussive injury.  A blast injury can cause CTE in a single event while in contact sports CTE usually requires repetitive injury.  A number of well known people may suffer or have suffered from CTE:  Junior Seau, Tony Dorsett, Brett Favre, Bernie Kosar, Jim McMahon, Art Monk, and John Mackey.

Top Rockingham County Reckless Driving Lawyer: Several years ago Scott Wilson, an American Actor in his 70s was stopped for a possible DUI.  The relevant Officers insisted that Wilson perform the field sobriety tests.  They did so even though the standardized field tests were originally vetted for persons no older than 60 years of age.  Some time thereafter the tests were claimed to be available to drivers as old as 65 even though no new validation studies were attempted.  Even though Wilson was too old for the tests to provide a valid correct arrest decision the officers used them to justify his DUI arrest.  This is one of the problems with the current use of the standardized field sobriety tests — the officers use them as impairment tests rather than as indicators of a blood alcohol level above or below the legal limit.  The investigators who developed the tests were very clear that roadside impairment tests could not be conducted at roadside.  Instead, they developed roadside tests that could project a probability of a blood alcohol content above or below the legal limit.  Officers need to understand a proper use of the roadside tests to make a correct arrest decision.
